GENERAL TERMS AND CONDITIONS Les Reliefs prints and writings

1. Definitions

1.1 Les Reliefs prints and writings: Maurice de Rooij (docerend) Kunstenaar, established in Utrecht, Chamber of Commerce no. 68602251 (also referred to as ‘we’, ‘us’ and ‘our’.)
1.2 Customer: the party which Les Reliefs prints and writings has entered into an agreement with.
1.3 Parties: Les Reliefs prints and writings and costumer.
1.4 Consumer: a customer who is an individual acting for private purposes.

2. Applicability

2.1 By visiting our website and/or purchasing something from us, you agree to be bound by the following terms and conditions.
2.2 These terms and conditions apply to services, offers, orders, agreements and deliveries by or on behalf of Les Reliefs prints and writings, unless explicitly having agreed upon otherwise in writing.

3. General Terms

3.1 By agreeing to these terms and conditions, you state that you are at or above the age of majority in your state of residence, or that you are at or above the age of majority in your state and you have given us your consent to allow any of your minors to use this site.
3.2 You may not use our products for any illegal or unauthorized purpose, including, but not limited to, copyright laws.

4. Pricing

4.1 All prices used in the webshop by Les Reliefs prints and writings are in euros, are inclusive of VAT and exclusive of other costs such as shipping or transport expenses, unless expressly stated otherwise or agreed upon.
4.2 Les Reliefs prints and writings is entitled to adjust all prices for its products shown in its webshop at any time.
4.3 Increases in the cost of prices of products or parts thereof, which Les Reliefs prints and writings could not foresee at the time of the conclusion of the agreement, may result in a price increase.
4.4 The consumer has the right to terminate an agreement as a result of a price increase as referred to under paragraph 4.3, unless the increase is the result of a statutory regulation.

5. Products

5.1 The products in our webshop are only subject to return according to our Return Policy.
5.2 The products in our webshop have limited quantities and are handmade products, although they are handled with great attention to detail and care, slight differences in colour and detail are always a possibility.
5.3 We make a great effort in ensuring that the images in our webshop are representative of the visual aspects (colours, shapes, textures and materials) used in our products. We are not accountable for differences in said visual aspects due to E.G. the customers computer monitor.

6. Orders

6.1 We reserve the right to refuse service to anyone for any reason at any time.
6.2 Delivery of products takes place at the address indicated by the customer.
6.3 Any delivery time specified by us is indicative and does not give the customer the right to dissolution or compensation. 
6.4 Les Reliefs prints and writings is not responsible for any mistakes made in deliveries caused by couriers and postal services.
6.5 In the case of a fault or mistake in the delivery of ordered goods, the customer can send a notification to shop[at]mauricederooij.com , after which we will start an investigation.

7. Payments

7.1 Les Reliefs prints and writings may, at the conclusion of the agreement, require down payment of up to 50% of the agreed amount. 
7.2 The customer must have paid the full amount within 14 days, after delivery
7.3 When the customer has not paid the agreed amount on the last day of the payment term, he is legally in default, without Les Reliefs prints and writings having to send the customer a reminder or to put him in default.

8. Consequences of late payment

8.1 When the customer does not pay within the agreed term, Les Reliefs prints and writings is entitled to charge an interest of 2% per month from the day the customer is in default. 
8.2 When the customer does not pay within the agreed term, Les Reliefs prints and writings may suspend its obligations until the customer has met his payment obligation.
8.3 When the customer is in default, Les Reliefs prints and writings is entitled to invoke the right of recovery with regard to the unpaid products delivered to the customer., any costs for the collection of the products are at the expense of the customer.

9. Right of withdrawal

9.1 A consumer may cancel an online purchase during a period of 14 days after reception without any given reason provided that:

– The product has not been damaged

– The product is sent back in the original packaging

– The consumer takes responsibility for the returning costs
9.2 The consumer can notify his right of withdrawal via shop[at]mauricederooij.com, and must use his right of withdrawal within 14 days after the notification of said right.
9.3 Once the goods have been returned and inspected, Les Reliefs prints and writings will issue a refund to the samen payment account that was used at checkout.
9.4 In the case of a commissioned work, the costumer has the right to withdraw from the agreement after the following phases of the commission process:

– Phase one: The phase in which Les Reliefs prints and writings provides the customer with first design sketches, from which the customer chooses one to be able to move on to phase two:

– Phase two: The phase in which Les Reliefs prints and writings develops the chosen design sketches into two final designs, from which the customer chooses one to be made into the final work.

9.4.1 The customer cannot withdraw from the agreement during phase three, during which Les Reliefs prints and writings works on the final work.
9.4.2 If the customer uses the right of withdrawal after phase one or two, the customer will only be charged with the costs made up to that phase.

10. Retention of title

10.1 Les Reliefs prints and writings remains the owner of all delivered good until the customer has fulfilled all his payment obligations. Until then, we can invoke our intention of title and let the goods be returned.

11. Complaints

11.1 If a delivered product does not comply with what the costumer could reasonably expect from the description, the customer must inform Les Reliefs prints and writings of this as soon as possible via shop[at]mauricederooij.com.
11.2 The customer is expected to provide a detailed description of the shortcomings.
11.3 The customer has the right to receive a proposal to resolve the dispute as soon as possible, but no later than two weeks from the moment the complaint was received by Les Reliefs prints and writings.

12. Liability

12.1 Les Reliefs prints and writings is only liable for damage the customer suffers if this damage is caused by intent or gross negligence.
12.2 Les Reliefs prints and writings is never liable for indirect damages, such as consequential loss, lost profit or damage caused by, or to third parties.

13. Changes in the terms and conditions

13.1 Les Reliefs prints and writings is entitled to modify these general terms and conditions. In the case of major changes in these terms and conditions, the customer will be notified, and is entitled to the right of cancellation of the agreement following these changes.

14. Applicable law

14.1 These terms and conditions are applicable under Dutch law.
